NEW

International construction, infrastructure, energy, transportation, development, and engineering projects involve multiple stakeholders, complex contractual arrangements, diverse legal systems, significant financial investments, and substantial technical risks. As project complexity increases, disputes relating to delays, variations, payments, extensions of time, defective work, force majeure events, contractual interpretation, risk allocation, and performance obligations have become increasingly common.

Disputes can significantly affect project delivery, leading to cost overruns, schedule delays, damaged business relationships, reputational risks, reduced investor confidence, and prolonged legal proceedings. In many international projects, the financial and operational consequences of unresolved disputes can be severe, particularly where multiple contractors, consultants, financiers, government agencies, and international partners are involved.

Modern project management increasingly emphasizes dispute avoidance rather than dispute resolution alone. Effective contract administration, proactive risk management, timely communication, collaborative problem-solving, early warning mechanisms, proper recordkeeping, and structured claims management can significantly reduce the likelihood of disputes escalating into costly arbitration or litigation.

The FIDIC (Fédération Internationale Des Ingénieurs-Conseils) suite of contracts has become the global standard for many international infrastructure and construction projects. FIDIC contracts provide detailed frameworks for contract administration, risk allocation, claims management, dispute avoidance, dispute adjudication, and dispute resolution. Recent editions place particular emphasis on proactive dispute avoidance through the use of Dispute Avoidance/Adjudication Boards (DAABs), collaborative contract management practices, and early intervention mechanisms.

In addition to FIDIC, international projects increasingly rely on Alternative Dispute Resolution (ADR) mechanisms such as adjudication, mediation, expert determination, dispute boards, negotiation, and arbitration to resolve disagreements efficiently while minimizing disruption to project delivery.
