ForElite Training Institute (FORELITE) T&Cs

Introduction

The following constitute the terms and conditions to which applicants agree when booking any ForElite Training Institute training courses (Terms and Conditions). Throughout the terms and conditions, (FORELITE) stands for ForElite Training Institute. ForElite Training Institute reserves the right to review and update these periodically.

Parties: These Terms and Conditions ("Agreement") are entered into between:

ForElite Training Institute (FORELITE), hereinafter referred to as the "Service Provider" or "FORELITE," whose principal place of business is located at [Bazaar Plaza, NAIROBI, Kenya]. The User or Customer, hereinafter referred to as the "User" or "Customer," who is the individual or entity booking any ForElite Training Institute training courses and agrees to the terms and conditions outlined in this Agreement.

Acceptance of Terms:

By accessing, using, making a purchase, or booking any ForElite Training Institute training courses, the User acknowledges and agrees to be bound by these Terms and Conditions. If the User does not agree with any part of these terms, they should not proceed further with the booking or use of the services. The User acknowledges the importance of carefully reading and fully understanding these Terms and Conditions before using any services provided by ForElite Training Institute (FORELITE). These terms govern the relationship between the User and ForElite Training Institute and outline important rights, obligations, and responsibilities. If the User has any questions or concerns about these terms, they should seek clarification from ForElite Training Institute before proceeding.

Key Terms and Definitions:

ForElite Training Institute (FORELITE):

Refers to the corporate training organization providing training courses and services as described in these Terms and Conditions.

User or Customer:

Refers to the individual or entity booking any ForElite Training Institute training courses and agreeing to the terms and conditions outlined in this Agreement.

Training Courses:

Refers to the educational programs, courses, or services offered by ForElite Training Institute for which the User may register and participate.

GDPR:

The General Data Protection Regulation, a regulation in EU law on data protection and privacy concerning the processing of personal data.

VAT:

Value Added Tax, a consumption tax levied on the value added to goods and services at each stage of production or distribution.

Face-to-Face Training/ Classroom Training:

Refers to training courses conducted in physical locations where participants attend in person.

Online Course/ Online Training:

Refers to training courses conducted over the internet, which participants can access remotely.

Services or Products Offered:

ForElite Training Institute offers a range of professional training courses and educational services designed to enhance the skills, knowledge, and competencies of participants. These services include:

Training Courses:

ForElite Training Institute provides training courses covering various topics and disciplines. These courses may be delivered through face-to-face sessions, online platforms, webinars, or other suitable mediums.

Educational Materials:

Participants in ForElite Training Institute training courses receive relevant course materials, which may include but are not limited to course outlines, study materials, and reference resources.

Support and Communication:

ForElite Training Institute offers support to participants throughout the training process. This support may include communication through email, messaging platforms, or other means to address inquiries, provide updates, and facilitate a smooth learning experience.

Face-to-Face Training/ Classroom Training:

For face-to-face training courses, ForElite Training Institute may provide refreshments and lunch during the training day(s), as specified in the course details.

Terms and Conditions

1. Registration with ForElite Training Institute

When booking a training we require you to register and provide us with certain information about yourself. In doing this, you agree to: Provide true, accurate, current and complete information about yourself as prompted by the registration form.

  1. Training can be booked via the booking forms available on the ForElite Training Institute website https://forelitetraining.com/
  2. When you submit a booking for an online course, your submission represents an offer to the ForElite Training Institute to book you onto the course you selected. On submission of the training course or eLearning course form, you will receive an automated summary email of your selection.
  3. The ForElite Training Institute will accept your offer by entering your booking onto the ForElite Training Institute system and sending you an email confirming that you have been booked together with information on starting your learning.

2. Prices, sales taxes/VAT

  1. Notice of new pricing will be given in advance, but the ForElite Training Institute reserves the right to change prices listed without notice.
  2. The training course fees include: tuition on the day(s), all relevant course materials, and if the course is face to face, two refreshments and lunch will be provided.

3. Payment

  1. Fees must be paid before the training is offered.
  2. Sales taxes (VAT) are charged at the applicable rate depending on the product and/or customer.
  3. We cannot invoice for fees, or accept payment, by installments.

Prevailing terms and conditions

Kindly note that this and all other ForElite Training Institute pre-contractual documentation shall not constitute an offer. All services provided by ForElite Training Institute are on the basis of these Terms and Conditions and if you wish to engage any ForElite Training Institute services, we shall only provide them if you accept the Terms and Conditions. If you offer to engage ForElite Training Institute on your own terms and conditions then we shall only accept your offer subject to the Terms and Conditions, which shall, if we provide the services you offer to engage, prevail over any other terms and conditions.

Ownership and intellectual property rights

All learning materials, whether on our website or at training day, are owned by ForElite Training Institute. All intellectual property rights in all materials available from the training, including the design, graphics and text of all printed materials and the audio of all webinars and podcasts, are owned by the ForElite Training Institute. When you are given access to the materials, you are granted a non-exclusive, non-transferable, revocable licence to use the learning materials. No training content may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without the ForElite Training Institute’s prior permission. Any such use is strictly prohibited and will constitute an infringement of the ForElite Training Institute’s intellectual property rights.

Special requirements at the training course

ForElite Training Institute will make every effort to accommodate special requirements that have been notified in advance on the booking form.

Health and safety at a face-to-face/ classroom training course

You must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which the training courses are provided.

Invitation letters

ForElite Training Institute an invitation letter as long as full payment of the training course fee has been received. ForElite Training Institute is not able to act on behalf of the participant and is not responsible for any costs incurred by failure to obtain a full visa.

Behavior

ForElite Training Institute reserves the right to remove any delegate/trainee from an ongoing training whose behavior is deemed inappropriate by ForElite Training Institute or its trainers. In these circumstances, the ForElite Training Institute will neither refund any fees nor reimburse any other costs.

Trainers

ForElite Training Institute shall provide such trainers to present the training course as it, in its sole discretion, deems fit and ForElite Training Institute shall be entitled at any time to substitute any trainer with any other person who, in ForElite Training Institute’ sole discretion, it deems suitably qualified to present the relevant course.

Liability

ForElite Training Institute does not accept responsibility for anyone acting as a result of information in, or views expressed on, its training courses including course materials. Opinions expressed are those of individual trainers and not necessarily those of ForElite Training Institute. Participants should take professional advice when dealing with specific situations.

Technology

ForElite Training Institute does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.

Joining Instructions

Joining instructions including an outline of the day and venue details (if the course is held face to face) will be provided prior to the course start date via the email.

Personal data

The personal data you provide when you book the training course will be held in accordance with GDPR and used by ForElite Training Institute for the purpose of delivering your training course. Your full name, job title and employer will be shared with your trainer in advance of the course.

Cancellation Policy

Cancelling Your Booking:

  • If you need to cancel your place on a training course, you must notify ForElite Training Institute via email at least 7 days before the course start date.
  • Cancellations received more than 7 days before the course will receive a full refund, minus a 20% (plus VAT) administration fee.
  • Cancellations received less than 7 days before the course will not be refunded.

Substituting Your Place:

  • If you need to substitute your place on a training course, you must notify ForElite Training Institute via email.
  • Substitutions made more than 7 days before the course incur no fee.
  • Substitutions made less than 7 days before the course will incur a USD 50 administration fee.

Transferring Your Booking:

  • You can transfer your booking to the next available training course with the same content.
  • The transfer option only applies to the same course and must be specified at the time of transfer.

Cancellation by ForElite Training Institute:

  • ForElite Training Institute reserves the right to cancel a training course in extreme circumstances.
  • We will try to reschedule the course and inform you of the new date and location (if applicable).
  • If rescheduling is not possible, we will offer you an alternative (e.g., virtual training) or a free transfer to the next available course.
  • If none of the above options work for you, we will offer a full refund of your course fees.
  • Any travel costs incurred are your responsibility. Refunds will be processed within 28 days via bank transfer to the original payer.

Non-Attendance:

If you fail to attend the course without prior notice, we will be unable to offer a refund or transfer.
